Terms and Conditions of the Online Store PREZERWATYWY4U.PL

§ 1. General provisions

  1. The online store PREZERWATYWY4U.PL, available at https://prezerwatywy4u.pl, is operated by NOWY KROK Sp. z o.o., with its registered office at ul. Sportowa 6, apt. 59, 35-111 Rzeszów, Poland, entered into the National Court Register (KRS) under number 0001057330, share capital: PLN 5,000, NIP 8133903455, REGON 526356818.

§ 2. Definitions

  1. Consumer – a natural person concluding a contract not directly related to their business or professional activity.
  2. Seller – NOWY KROK Sp. z o.o., with its registered office in Rzeszów, Poland.
  3. Customer – any person making purchases via the Store.
  4. Entrepreneur – a natural or legal person conducting business activity and using the Store.
  5. Store – the online store operated by the Seller at https://prezerwatywy4u.pl.
  6. Distance contract – a contract concluded without the simultaneous physical presence of the parties.
  7. Terms and Conditions – these Terms and Conditions of the Store.
  8. Order – a declaration of intent submitted by the Customer aimed at concluding a Sales Agreement.
  9. Account – an individual customer account in the Store.
  10. Product – a movable item or service being the subject of the Sales Agreement.
  11. Sales Agreement – an agreement concluded between the Customer and the Seller.

§ 4. Technical requirements

  • a device with Internet access and a web browser,
  • an active e-mail address,
  • enabled cookies support.

§ 5. General information

  1. The Seller shall not be liable for interruptions in the operation of the Store caused by factors beyond its control.
  2. Orders may be placed with or without creating an Account.
  3. All prices are given in Polish zloty (PLN) and include VAT.
  4. The total price includes the Product price and delivery costs.

§ 6. Customer Account

  1. Creating an Account is voluntary and free of charge.
  2. The Customer may delete the Account at any time.

§ 7. Placing orders

  1. Placing an Order constitutes an offer to conclude a Sales Agreement.
  2. The Sales Agreement is concluded upon confirmation of the Order by the Seller.

§ 8. Delivery and payments

  1. Delivery is carried out exclusively within the territory of Poland.
  2. Available delivery and payment methods are specified on the Store’s website.
  3. In the case of choosing cash on delivery (COD), the Customer is obliged to collect the shipment, which constitutes an element of proper performance of the Sales Agreement. In the event of unjustified refusal to accept the shipment or failure to collect it within the specified time, resulting in non-performance of the Agreement for reasons attributable to the Customer, the Seller shall be entitled to charge the Customer the actual costs incurred for the return shipment, including the cost of returning the Product to the Seller. This provision does not limit the Consumer’s statutory right to withdraw from the Agreement.

§ 9. Performance of the Sales Agreement

  1. Orders are fulfilled within the time limits specified in the Product description.
  2. If an Order includes Products with different delivery times, the longest stated time shall apply.

§ 10. Right of withdrawal

  1. The Consumer has the right to withdraw from the Sales Agreement within 14 days of receiving the Product.
  2. Withdrawal requires submitting a relevant declaration.
  3. Refunds are made in accordance with Polish law.

§ 11. Complaints

  1. The Seller is liable for defects in Products in accordance with applicable law.
  2. Complaints may be submitted in writing or electronically.
  3. Complaints are examined within 14 days.

§ 12. Personal data

  1. The Seller is the controller of the Customer’s personal data.
  2. Personal data are processed for the purpose of performing the Sales Agreement.
  3. The Customer has rights provided for under GDPR (RODO).

§ 13. Final provisions

  1. These Terms and Conditions are governed by Polish law.
  2. In matters not regulated herein, generally applicable provisions of Polish law shall apply.
  3. The Customer has the right to use the ODR platform: http://ec.europa.eu/consumers/odr/.
